I believe any efforts to make USICIS accept all applications can be couter productive. You can have some people getting stuck for sure for many years before they get their green cards. also since new fees kick in on July 30th, you will have to pay for the EAD,AP.
The law-suit can benefit only a few of us, so why is IV behind this.
Can the core members comment on this.
I tihnk all these efforts do not define a common cause right now.

EB3-India cannot be discriminated.
Anyone in EB3 after 2-3 years waiting is qualified under EB2-I. And we see people waiting for much more. How can we be discriminated then. We have to do something.
We are able to get very good number of people with like minds in Edison, NJ and other big cities with big concentration. We are planning to start a drive against this discrimination, in about 2-3 weeks from now. We would like to write to the honorable policitians and processing centers like Texas and others and to USCIS to treat all fairly.
1. EB3 India cannot be treated unfairly, wheras EB3-China is much ahead. Why is this.
2. EB2-India is Feb 2004, wheras EB3 India is Nov 2001 for many years. Why is this.
3. Why are allowing family immigration when skilled immigrants are waiting.
4. Why should greencards be counted head-wise, whereas H visas are not.
5. On the whole, why backlogs and punishing us.
These are the lines in which our group plan to drive this.,send more ideas.
For this we need money and more impo'ly efforts, so please contribute smartly as we request below.
We have teams in all major software hubs like NJ, DC, Livermore, CA, TX, Detroit, and and will need volunteers. We will soon come up with a yahoogroup to communicate.
We plan to send 10,000 letters and other awareness programs letters to the concerned people.
We plan to have our small booths in temples where many people will come.
We will print all the letters, you just need to buy the stamp from us and mail it.
Or give us an envelope with the 42c stamp. We need about 5-10 from you all.. So its will be $5.00 per head. That way there will be no quesiton of transparency. But if you want to donate more, you are welcome, instead we will prefer you put your efforts in creating strenghr and pass the word.
We cannot keep quite like this. There is no reason why EB3-India will move forward in current situations and with current rules.
We know EB2 will be upset, but based on your contribution, we can fight together, else we will go alone. EB3 is big enough to go by itself.

Trust me my friend, I have seen it happen all the time, from large Telecom firm to Govt., its always there, most of the consultants just doesn't come to know about it, but the cut for the managers is there in some form, almost always. Why do each manager has a specific vendor through whom they want to hire most of the time? What else is the reason for the client to pay the consulting company $180/hr but they won't give 'valueablehurdle' anything more than $50-60/hr?
On a different note, now that NSG approved the waiver, most desi uncles, some of them are also owners of desi consulting companies will claim that they are the father of Nuclear deal. These bastards (sorry for my french) always oppose any GC fix and they tell their favorite congressman/senator (each has atleast one favorite politician for whom they do fund raisers) that gc backlog is not an important issue for the community. India Abroad, Times of India, rediff and other desi portals/newspapers will write 'Oliver North' style stories about these desi uncles knowing well that companies like GE etc put their weight behind the deal as it will create commerce to commerce over $20 billion/yr. But desi uncles/orgs will not stop claiming to be the father of nuclear deal. The fact is, most of these desi uncles made noise not because they wanted to do something for their country of birth, they are doing it because they think that if the nuclear deal passes, they can play middle man for US companies to sell the technology/material to Indian companies/govt. Most of the so called 'united voice of Indian-Americans on the Hill' organization's goal is to make big bucks by playing 'middle man' for companies wanting to sell technology to India. And as always, just as 'valuablehurdle''s client (paying $180/hr) Indian govt. will pay double the cost. These desi companies have squeezed blood of people waiting for gc, but now they think its time to move on to play big game with the big boys. Outlook is very very grim without a bill from what I understand. EB3 India is going to be in a hole and EB3 PDs that are 2006 and later have a really long wait time ahead that they are not imagining. We are all hopeful by nature and look forward to visa bulletins with a positive attitude but such PD folks may be disappointed month after month for several years. For EB2 India it is important to know number of ported cases. EB3ROW folks also need to worry now. Their journey may not be that smooth due to spillover rules and high demand. We need to get data via FOIA to make a better guesstimate. Without such data we will hear various theories, predictions and interpretations from various websites and blogs that may not be always true.

I have not heard of any case, where they rejected an application because the "payable to" name was an issue.
We need an expert who knows how check processing works between 2 physical people, in our case, we people and USCIS and then later between the 2 banks, in our case, our banks and USCIS's bank.
Another example: My company accepts checks under a full name and also if paid using an abbreviated name. But thats because we have told our bank to accept such checks.
USCIS must have also done the same thing, they must have informed their banks too. All they are trying to do is TRAIN all people in the US, to write checks to only 1 name which is "US department of homeland security", because thats their umbrella organisation. It will take people some time to learn about the new change. But they wont reject applications because of that, unless there is a big difference. I am sure they will accept checks if you say "USCIS" or its full form. Money is going, finally, to the same place.
Most important bottom line : If they plan to reject applications if check names were not accurate, they are legally supposed to write that in the instructions that they will do so. If they themselves are confused they will issue an RFE or something and request you to send a proper check.
THEY SIMPLY WONT REJECT.
LAWYERS are SIMPLY WAITING FOR SUCH THINGS TO HAPPEN.
So people stop panicking. Dont worry.
Give your self 1-2 weeks and keep checking bank and call USCIS.
Bottom line for people who are yet to file : DO EXACTLY AS WRITTEN in the INSTRUCTIONS. IF you lose concentration and dont do things correctly, these tensions arise. FIND TIME AND READ READ READ.

If spelling bee competition is considered merely as just cramming the dictionary, as you rightly said we need to really spend some time looking beyond your own shell.

Its a good move, I know that this initiative was started by an Officer from US Army whose interpreter was getting death threats for helping the US. When he saw that it was not an isolated incidence he started lobbying the state department to create a separate category. I have been following that story for a couple of months, but was not aware that a bill was passed to create a new category or visas. (i am sure, that USCIS cannot take a unilateral decision to add more visas or else why would we be begging for recapture bills)

I think that is an Open category and anyone who can show that their life is in danger in their Homeland can apply...For Iraq, since tehre are too many, they may be limiting 5K per year...

I do know recently where a person who got married before his greencard approval and filed his wife's case. He got approved but then three months after his approval; his wife has been sent to local office interview. I'll let you know what the outcome of that will be.
Another person was on F-1 and went straight to greencard through Schedule A. he got married after he filed for 485. Since he didn't have any non immigrant status; he could not bring his wife here. She had to do follow to join and chennai consulate asked all sorts of questions. Tax returns, w2's, letter from employer; when he joined and when he left.
Think of it this way; were you traveling before greencard with same employer? If you were then what would have changed that all of a sudden you don't like it. It would be a more plausible excuse if you didn't travel at all before and they started to make you do it after greencard approval.

My friend recently came through EWR, he had no issue other than more waiting time (approx 1 hr). He just showed his AP & Passport. He was sent to other counter, upon which they asked only one question 'Are you the same person that it is displayed in the AP document' :)
Everything went cool with him. His I-94 is valid for 1 year from the date of entry.

in the month of april my wife and I had received RFEs for 325 and birth certificate, we submitted the evidence and there was soft LUDs for almost a week, case status said a decision will be made in 60 days. I t is more than 90 days, so I called up the customer service (I very well know that they can't issue GC as the priority date is not current) I spoke to her as a layman and filed for a service request. Here is the email that I got:

Looks like we are in minority :), I guess people need to be educated about legalities of the immigration system, just because one applies for a green card , or one gets a Green card, he/she does not become part of the country.

Can you please provide us any link or legal constitutional document from any legal organization in India and USA which states that Patriotic Indian ( For the sake of argument Indian) should not apply for US Green Card ( Permanent residency)? Or for that matter can you legally proove that not applying for US GC is the barometer of patriotism towards India for an Indian?

Looks like we are in minority :), I guess people need to be educated about legalities of the immigration system, just because one applies for a green card , or one gets a Green card, he/she does not become part of the country.

Hi,
I found this interesting comment from a blog. It has been posted by an H.R. representative who has access to H1B and GC users' records. The points raised are indeed valid and they seem to have a 'case' against us. I do not by any means want to undermine our efforts but it does provide a perspective from the 'citizens' perspective.
The bill would also drastically increase the number of H-1B visas issued to foreign professional workers. As a Human Resources representative, I see first hand how the H-1B visa and employment based green card programs actually work together to drive U.S. white collar workers from their jobs and even from their careers. To begin with, there is virtually nothing in the law that prevents employers from hiring H-1Bers for open positions even if qualified Americans are available and willing to do the work. Americans are routinely laid off and replaced with lower paid H-1Bers also. In these cases, Americans have practically no legal recourse available under current law. H-1B is also a dual intent visa, so an employer may sponsor an H-1Ber for an EB green card for legal permanent resident status. When a company seeks to sponsor a foreign worker for an EB green card, they are required by law to demonstrate a good faith effort to recruit Americans first. This process is called labor certification. But employers routinely game the labor certification process for green card sponsorship to defraud even well qualified citizen job applicants in favor of low wage foreigners. They use fake job ads and/or bad faith interviews of American citizens to convince the federal government that they tried to find American workers first. These practices are common in high tech and even in some non-tech industries, but HR people are told to keep quiet about it or lose their jobs.
I would be in favor of a program that issues a small number of self-sponsoring green cards for truly innovative foreign nationals on a competitive basis. But very few of the H-1Bers or green card applicants that I have seen in 10+ years even come close to being truly innovative. Most are just practitioners with skills that are actually quite common among the domestic workforce. The only thing special about these foreigners is that they will work for substantially less than Americans in order to have a chance to become legal permanent residents. Thus they are used by management to sweeten corporate balance sheets.
The prevailing wage regulations are supposed to insure that foreign nationals are paid the same as their American counterparts in the same job functions, but these regulations are so riddled with loopholes that they are a bad joke.
Since my work allows me to have access to salary records, I can tell you that the labor cost savings for H-1Bers and green card applicants is substantially greater than the costs of filing the applications with the government.
Citizens should demand that both the H-1B and employment based green card programs be abolished in their current form.
My point is if we check our credentials, how many of us are 'true' innovators? I know I am not, I am an expert in what I do and am an asset to my company but I haven't filed any patents or publications which would be the true requirement for this country. My skills are indeed readily available in domestic workers as well. Could that be the reason for the backlog in EB-3 and none in EB-1? So do we need to do a reality check here? Just wondering if this could be the reason why we're getting a raw deal. Could it be that 'highly skilled' is not enough but 'genius' and 'highly skilled' is what's required here? Just a thought.
Dont blame you for being concerned after reading this post. We at IV dont disagree that there are a few instances where infact below average skilled people are employed on H1bs. However, look around a little, talk to fellow foreigners (Indians/others) whom you meet somewhere and you will realize that they dont just supply cheap labor OK. They are indeed very qualified for the job they are put into. I know for example the job that I do CAN be done by an american citizen without any problem (if he /she is trained) but the fact is that, there is NOBODY around. REALLY there is nobody around. Now reg software, many of my software friends are highly talented individuals (not inovative in the sense you mean) without whom the industry will COLLAPSE and your HR person will have nobody to hire because he/she will have to go home. Remember also the fact that IT industry is now at a slowly developing phase and they need people to work for lower wages and cant survive to fill in all slots with the american worker who will want more money for lesser work time and that proves the HR persons point--work for lesser money (THAT INFACT IS THE MAJOR REQ FOR IT INDUSTRY AT PRESENT)

What argument will they have for ppl who have been waiting for 10+ years to get a GC.. ;-) (and they should be outside the quota..)

You've been waiting 6 years .... How about 6 more? If this thing passes in a similar form, would you rather again re-apply in a current category (that will not retrogress) or wait in your own (Eb2-Eb3) category for another 6 years (since that is probably how long it will take for the USCIS to process your app once the flood gates open)?
I've been here a looong time, though I started my GC processing only in 2005. I recently got laid off which is why I now have the time to check developments in the immigration world.
