they are talking about about nursing shortage,,, I"m an RN unable to work becuase of the current situation. RN educated in US .... and they talk about why there is nursing shortage. There are hundred nurses inside us unble to work becuase of this situation......sheesh... this is sad.

Disclaimer: I am just someone who once seriously considered getting a degree in Strategic Studies. I am not from India. If you don't like what I have to say or feel that it is not my *place* to say it, just ignore me. I will not get engaged in an online wrestling match to demonstrate my "e-toughness".
It will not have any major repercussions b/w the 2 countries or any impact on the Green Card situation. Relations b/w US and India encompass a much broader spectrum than just a large defense contract. India's economy presents enormous opportunities for US companies, there is the issue of countering China and not to mention the same view on most regional as well as international security issues. They will not get any where if they start slugging it out every time there is a lost trade deal. India has helped US in the past with Iran's nuclear program while US has shown the importance it gives India by pushing an exception from NSG in nuclear energy.
If anything I am surprised that US is surprised that they lost the bid. Both Rafael and the Typhoon are amazing platforms. I did not read the actual RFP but it is arrogance to assume that the US offerings were inherently any better than the European offerings.
@kumara121: I can assure you that Uncle Sam does not want to "..come and check the planes whenever and wherever it wanted to". If I only had a dollar for every conspiracy theory I hear from people from our part of the world (Pakistan, Indian, Bangladesh) I would have been in Eb-5 years ago :)
The biggest issue was that the US offerings were very comparable to existing Mirage 2000 platform that IAF already has. The MRCA is a long term upgrade and does not make sense to get a plane that is so close to the existing inventory.
Bottom line? The GC aspirants did not gain or loose anything. IAF won by getting a hot fighter, the only loosers are Boeing and Lockhead.

I know this is easier said than done but I think for most part I have moved on .I have not got my GC yet (PD Nov 2003 EB3 -India) but allow me to chime in .
Actually I had little interest in pursuing GC to begin with(Mistake). Could have started earlier than I actually did and was lucky to breeze thru Labour and 140 stages(< 6 months) and did not follow I-485 progress till June -1 st 2007
Then suddenly in next 4-5 months browsed every info /problems/issues with GC. Made 3 info pass appointments(Name Check cleared), initiated 2 separate inquiries one thru OMBUDSMAN. must have called USCIS about 10 times and checked the online status atleast 3 times a day . Pedantic. Mostly because my application was pre-approved and lot applications around my PD's were approved and I thought I was really close . Alas, that was not to be . I was pretty dissapointed for a few months.
However in the last 6 months I have moved on mentally, I browse IV and consider other options like switching to Eb2 but gone are those pedantic days followed by huge disappointments.
Planning a career move with AC21/EAD option.

I know after we file the i-485 for 180 days, we can change our jobs. But rule is that the new job should be in the same field as the old one.

Can anyone care to take a guess at this please. Especially seniors who are pretty familier with the backlog.
What I am trying to figure out is if the current backlogged cases for Indians are about 120K, how many could be there for China/Mex/Phil?
Could it be as high as 70K? or less?
I would appreciate someone taking crack at this.
My blind guess is about 50K. Leaving EB3 ROW with a backlog of 30K.
If China and Mexico and Philippines backlog is like 60 or 70K that means ROW will be current by the end of the next fiscal year.
This would result in over flow of the excess to retrogressed countries.

this could be read 2 ways...either you need have an approved I-140 prior to filing for portability OR the adjudicator needs to approve the I-140 prior to determining portability.
You can read it 10 ways, but the CIS has only one interpretation(see bold below).

Online status does not change when they send FP notices.
There will be a change in LUD after you give FP.
Will they not update status when they send any FP notice? Even if one misses the letter, one will get an idea whether something happened or not. Or are you saying that they don't even change the status when they send FP notice and if it misses to reach us we never would be knowing at all??
Can anybody clarify whether they update at the online status system when they send FP notice. Otherwise there is some reason for a mild worry; still don't see any reason for the kind of anxiety people are having for not having FP.

NKR, not sure if you heard about this one proverb... "jabh kismath GA***U hai tow kya karey ga PANDU"....we unfortunately get trapped with such type of employers who trouble their employees and learn lessons in hard way and looks like you haven't encountered any such experiences with your employer, if that's the case you are lucky enough & I wish you would NEVER fall into such employers hand who trouble for so many other different reasons....or not sure you should have one small experience and see how you feel just for the heck of it....

After the company got acquired, the acquirer restarted the GC for everyone (typically a successor in interest company picks up the GC as-is and things can continue, but there have been cases where lawyers recommend restarting because of all the changes in the job location/profile etc).
Many people who came here in 2000/2001 have a PD of 2005/2006. It really sucks (I am in the same boat)

I think it was Zoe lofgren who sent a letter with very pointed questions to USCIS. I don't believe they made public their answer or if they answered it at all; and instead of fighting with Senator they reversed course and opened up the visa dates again. (A big part of me thinks that it was pure financial decision. USCIS was going to have fee increase and they realized that they would lose a lot of money but after they did their analysis; they realized their breakeven point was each candidate renewing ead/ap once and they would break even. They would even come out further ahead by allowing the applications because people would be renewing at least three times whereas in old fee structure it was only built in for one renewal).

Eb2 will move gradually but it may move up to 2006 or 2007 as Eb1 spill over and Eb1 and Eb2 spillover from other countries will be transferred to Indian and Chinese Eb2. Again it depends on how many people are waiting in Eb2
I do not have the numbers in front of me, but I think the EB1 spillover numbers have been reduced over time. EB1 gets lot of usage in the EB1C (multinational managers) for India.

I live less than 15 miles from TSC, my I-140 is approved from texas, but my wife's case(dependent on me) went to CSC. I don't know mine yet. Is CSC good or bad not sure. I am seeing they are approving EAD and AP faster than than TSC/NSC. My application was filed at NSC on july 20.
