EB3 140 is already approved on Jan 2006, we re-applied 140 again on EB2 but got the Priority date of EB3 for EB2 of Sep 2005. But I Think priority date is only for Labor not 140, so my 140 for EB2 is still May 21 isn't it?

Because of sudden influx of projects coming to India last year, there was a temporary upsurge in the demand for skilled personnel in india ....So there are many options for these people which caused the higher attrition as they have many options open....So temporarily these IT Companies used to retain highly skilled employees at any cost and kept them in front line and recruited some freshers (i have seen one company recruited freshers and charged them 50,000 ...you heard it right :0 initally with the commitment of 2 years).
As the freshers are catching up with the experienced ..i see a sharp decline in demand my area of expertise from past 6 months to an Year .... But from CEO point of view , still work is done ..with 40 % or more saving ..may be for little compromise on quality ....
I have a feeling that attrition rate may slow down in coming years .....
Any one please share your views /experiences ..

Do you realize that this duplicate App is going to increase the turnaround from 90 to 120 days ?
Please put some thought man - USCIS clearly said that FEDEX/USPS signed receipt is acceptable proof for EAD/AP filing in one of the FAQ's so if its get rejected out of USCIS error you can refile later.

I think there are valid reasons for SOME of us to re-file but in general it should be avoided as much as possible. We are 20000 odd people here in TOTAL. That is about 7% The total number of applications received by USCIS (maybe 300000). So, while you are right there is no need to re-file just out of anxiety, I don't see how it will make any impact on the processing times.

I think EADs are sent to the applicant and AP to the attorney...had the same in my case...plus seen lots of folks here say the same thing...
Arent you concerned that if its approved on Oct 1, and you didnt get it, then where is it? Did you ask them as to why you havent gotten it in mail even though it has been approved a month ago? Also, did you check with your lawyer if he got anything?

i was in a similar situation about this with a priority date of Jan '06.. i was planning to get married in dec 2009.. but my dates were current and fearing that I might get my GC soon, I rushed to Australia (my fiancee is AUS citizen) and got a registered marriage done... she is still in aus and planning to join me later using following-to-join when i do get gc.. unfortunately, I did not get my GC when the dates were current in Aug or Sep...
but, i dont know how to advice you.. it is a very sticky situation... i think best option is to do H1B, and before that to try and get some visitor visa... my lawyer says there is a 50% chance for one to get H1B if you apply on April 1st.. and almost 0% chance if you apply after April 1st...
oooh another option that i thought out, during my stressful thinking days about this, was that the H1B quota is not valid for certain jobs.. like doctors, and also if you work in like non-profit orgs and stuff... try to explore that.. this means that ur wife can get H1B right away...
F1 is not an options, since you have to show non-immigrant intent.

I am also waiting for a GC to buy a house ... can't buy on a H1 visa with a project that keeps on getting extended every 3-6 months. You need stability for at least a few years to put in a committment for a mortgage that you are going to pay for 30 years.
I also work in a IT consulting position but still decided to go ahead and buy a home in St Louis back in September 2007. My 485/EAD/AP was filed in August 2007 and EAD approved a few weeks back. However despite my current situation, I believe buying a home was a wise decision considering the kind of lifestyle and security it provides for you and your family. I know a lot of my friends who decided to take the plunge and bought houses though they were working on H1 and have their GCs pending for a few years.

It is dark age for immigrants in America. They are just inventing ways to harass people. There shouldn't be a reason to issue EAD or AP in time. They have increased the fees several folds in recent years. They want us to run pillar to post for everything, be it work permit, travel document, driver's license...Just discouraging aliens to live in this country.I am trying to understand the cause for this huge delay to issue either EAD or AP. Could it be due to a large number of I-485 filers in July 2007 that the agency is unable to handle the volume of requests (either for a new one or renewal)?
Has USCIS come up with any explanation as to why there is lot of delay to issue EAD renewals or new EADs? Could it be the US economy that is causing the drag on the agency?

You are not the only one. I have been waiting for my GC for 8 years now and it is nowhere in sight! I took the plan B (Canada) and became a PR there (it tookj just over a week, without the need for a job and without me leaving the USA, except to "land" there as the final step). Canada is not as bad as people may think. It looks just like the US, in many cases people are way nicer, multiculturalism is encouraged and enshrined in the Canadian constitution (as opposed to assimilation in the U.S.) and you have free healthcare and free social security for life, whether you are employed or not. Finally Canada has consistently ranked as one of the very top places to live worldwide (ranges from 1-5, it is 3rd this year, with U.S. in like #8) and there is so much to do there. Anyway, for a plan B, Canada is quite honestly pretty damn nice.
Trust me buddy - Canada is no heaven. If not USA, lets go back to our home-country - its way, way better. I have worked in Canada for a while (Montreal) and can tell you that it is no America. Not the standard of living, Not the technology, not the people, ofcourse not the weather :-) Just my 2 cents.

1) My screen name has nothing to do with the argument here. If we discuss my screen name we are going on a tangent which is very typical of desis (I rememeber womanly taunts in movies and woman gossip where they would pick anything but would niether make a point nor a valid argument)
so you can see where your argument is going..
2) Hopefull signifies optimism. A pessimist is an optimist who is very analytical or knows better. Your argument is similar to "And they lived happily ever after ...(after singing around green trees) ...." ignoring the ground reality, facts that no dent has been made and also turninga blind eye to the fact that there are people since 2001/2002 stuck. Its 2007 meaning five years and if the Dept is not willing to budge after all these efforts to a number more than 7000, and you still are HOPEFULL ignoring the facts means that you are an idiot. Yes you will get your GC before you die for sure provided you live upto the age of appx 70 and your consulting firm is around and you are not tired of the bickering with your employer.
Its just like a Yash Chora SRK movie ...it only happens in reel life and not real life ..

No human being is gaining anything in making several hundred thousand people to wait at a point in their lives. I hope that you get your green card long before everybody else. And I hope that you keep you FT job and you progress in your life more so than you expect.
Around 3 weeks back I got my green card. And if there was a way for me to give you my green card, I would have done so gladly. I did my masters in US a few years back and for couple of years during and just after my school years, a part of me used to think that working in consulting firm was below my standard and people getting education in US university are the only worthy human beings. After having lived through few years of my life at my job, now I have "slightly" matured from my yester years. Now I think that number of degrees doesn’t make some one better than others without a degree. I have worked at a full time job for last 7 years in a Fortune 10 company. Some of my best friends work for consulting companies and these are fine gentlemen. I have learnt a lot from my friends. In the end, I think it makes no difference how many degrees one earned or whether one is working for a consulting firm or at a FT. What we are made of is reflected in our behavior towards others around us and it has nothing to do with the number of masters degrees one has earned. Anyways, hope you get your green card soon and you do well in life. And I hope that you become source of peace and joy for others around you.

yes..agreed. But you are forgeting all the new EAD's (H4's) who will be part of the mix.
You have to compete with H4s on EAD (I might be generalizing here so apologies to anyone offended) you've got more serious issues than you have foreseen.
EAD is not a ticket to a high-paying job requiring a certain level of skill.
I feel this thread is going the way of a Programmer's guild forum in that "Now that I'm in the door, stop the offshoring" :D

Why don't you explain to everyone how is telling the OP that we do not condone taking or selling drugs something of a personal opinion?
